Saudi Arbitration Awards: What Can a Nullification Action Really Do?

Winning an arbitration does not mean the award is immune from challenge. Saudi law treats arbitral awards as final in substance, while preserving a defined nullification route for specified legal defects.

Can a Saudi arbitral award be appealed on the merits?

Not through an ordinary merits appeal. The Saudi Arbitration Law provides a nullification action on specified grounds rather than a general rehearing of whether the tribunal reached the right commercial conclusion.

How long does a party have to bring a nullification action?

The statutory period is generally 60 days from notification of the arbitral award. Businesses should record the service date precisely and manage post-award deadlines immediately.

What kinds of defects can support nullification?

The statutory grounds include issues such as absence or invalidity of the arbitration agreement, incapacity, improper notice that prevented a party from presenting its case, breach of agreed procedure or applicable requirements, defective tribunal composition, decisions beyond the agreed scope, and specified defects affecting the award or procedure. Sharia/public-order and non-arbitrability concerns also remain important under the law.

Does the court retry the factual and commercial dispute?

No. The nullification framework is limited review. The court does not simply re-evaluate the evidence or substitute its commercial judgment for the tribunal’s because one party disagrees with the result.

What should the winning party do after the award?

Check service, award formalities, translations where needed, the arbitration agreement, any pending nullification action and enforcement requirements. Post-award enforcement preparation should begin before the 60-day period expires, not after it.
